1. Acceptance of Terms
By downloading, installing, or using Zenpa, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application.
2. Description of the Service
Zenpa is offered by The Computer Firm Sàrl, a company registered in Switzerland ("we", "us", or "Zenpa"). Zenpa is a locally installed AI-powered assistant designed to help you capture, organize, and recall information across your desktop workflows. Your work content is processed and stored on your device. The limited account and service data we handle is described in our Privacy Policy.
3. User Responsibilities
As a user of Zenpa, you agree to:
- Use the software in accordance with all applicable local, national, and international laws
- Ensure the security and integrity of your device and the data stored on it
- Not reverse engineer, modify, or distribute unauthorized copies of the software
- Not use Zenpa for any malicious, illegal, or harmful purposes
4. Intellectual Property
The Zenpa platform, including its software, branding, and all original content, is our intellectual property and protected under applicable copyright and trademark laws.
Your personal data and any content you create or store using Zenpa remain yours. We do not claim ownership over your files, notes, or on-device content.
5. Service Availability
We aim to provide a reliable and performant product. However, we do not guarantee that the service will be available at all times. Temporary disruptions may occur due to updates, maintenance, or unforeseen technical issues. Zenpa is currently in early access, and features may change as the product evolves.
6. AI-Generated Content
Zenpa's answers, summaries, and suggestions are generated by artificial intelligence. AI output may be incomplete, outdated, or inaccurate, and may not reflect reality. We aim to provide information that is as accurate as possible, but we make no warranty as to the accuracy, completeness, or reliability of AI-generated content, and you should verify important information before relying or acting on it.
To the maximum extent permitted by law, we are not responsible for decisions made or actions taken based on AI-generated output. If you come across a wrong or misleading answer, please report it through the in-app feedback form. It directly helps us improve Zenpa for everyone.
7. Privacy and Data
Zenpa is designed so your work content stays on your device. For more information on the account data we handle, website analytics, and your rights, please refer to our Privacy Policy.
8. Limitation of Liability
To the maximum extent permitted by law, Zenpa and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of productivity, or loss of revenue arising from the use or inability to use the software.
Nothing in these terms excludes or limits liability for intentional misconduct or gross negligence, death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited.
9. Termination
You may stop using Zenpa at any time. We reserve the right to suspend or terminate your access to the service if you breach these Terms. Certain sections of these Terms may survive termination, including those related to intellectual property, limitation of liability, and governing law.
10. Modifications to the Terms
We may update these Terms of Service from time to time. If changes are significant, we will notify you by email or within the app. Your continued use of Zenpa after such updates indicates acceptance of the revised terms.
11. Governing Law
These terms are governed by Swiss law, without regard to conflicts of law principles. The courts at our registered seat have exclusive jurisdiction, subject to any mandatory consumer protection, applicable law, or venue rules that apply to you.
12. Paid plans and billing
Purchases, the 7-day free trial on Monthly and Annual plans, subscriptions, Lifetime licenses, billing via Stripe, and our no-refund policy are governed by our General Conditions of Sale. By accepting these Terms of Service, you also accept the General Conditions of Sale.
In short: Monthly and Annual start with a 7-day free trial, a card is required to start it, nothing is charged during the trial, and it converts to a paid plan on day 8 unless you cancel first. Lifetime plans have no trial. See Section 2.1 of the General Conditions of Sale for the full terms.
